Welcome to CANitude!

These Terms and Conditions, together with our Privacy Policy (collectively referred to as the “Agreement”), govern your access to and/or use of the CANitude mobile application available for download on the Google Play Store and Apple App Store (the “Mobile App”), and the CANitude website located at www.CANitude.com (the “Website”).

The Website and the Mobile App are collectively referred to as the “Platform”. All software features, functionality, materials, and services provided through the Platform are referred to as the “Service(s)”.

The Platform is owned and operated by CANitude, LLC, a limited liability company formed and operating under the laws of the State of Washington, United States of America.

Any reference to:

  • “the Company,” “we,” “us,” or “our” refers to CANitude, LLC
  • “you,” “your,” or “user” refers to any individual who registers an account and/or uses the Services as a Learner or an Expert

Important Notice

YOU ACKNOWLEDGE THAT CERTAIN JURISDICTIONS MAY REQUIRE YOU TO AGREE TO SUPPLEMENTARY TERMS.
IN CASE OF ANY CONFLICT BETWEEN THESE TERMS AND ANY SUPPLEMENTARY TERMS, THE SUPPLEMENTARY TERMS SHALL PREVAIL.

YOUR ACCESS TO THE PLATFORM IS EXPRESSLY CONDITIONED ON YOUR ACCEPTANCE OF THIS AGREEMENT.
IF YOU DO NOT AGREE TO ANY PROVISION, YOU MUST NOT USE THE PLATFORM.

1. Eligibility

1.1 Age Requirement

You must be at least 18 years old to register and use the Platform.

1.2 Minors

Users under 13 years of age are strictly prohibited from accessing the Platform.

In compliance with the Children's Online Privacy Protection Act (COPPA), we do not knowingly collect personal information from children under 13.

By registering, you represent and warrant that your use of the Platform complies with all applicable laws.

2. Definitions and Interpretation

2.1 Definitions

Booking
A Session reserved by a Learner with an Expert through the Platform.

Booking Agreement
The binding agreement between a Learner and an Expert for Expert Services.

Learner
A user who searches for or acquires Expert Services.

CANitude Credits
Credits used to book Sessions. All credits are denominated in USD.

Expert
A user who offers Expert Services on the Platform.

Expert Services
Professional services offered by Experts.

Listing
An Expert Service listed on the Platform.

Session
The scheduled time during which Expert Services are delivered.

Session Fee
The total amount payable by a Learner for a Session.

Review Period
The 72-hour period following the Session End Time.

2.2 Interpretation

  • Singular includes plural and vice versa
  • Gender references apply as context requires
  • Undefined terms take meaning from context

If translated, the English version prevails.

3. The Platform

3.1 Marketplace Nature

CANitude is an online marketplace connecting Experts and Learners.

3.2 No Employment Relationship

Experts are independent contractors, not employees of the Company.

The Company does not:

  • Verify qualifications
  • Guarantee service quality
  • Control Expert conduct

3.3 User Responsibility

Users are solely responsible for evaluating Listings and entering Bookings.

YOUR USE OF THE PLATFORM IS AT YOUR OWN RISK.

4. Experts

4.1 Expert Account Registration

  • Expert accounts are free to register
  • Approval is at the Company's discretion

4.2 Expert Features

Experts may:

  • Create profiles and Listings
  • Accept or reject requests
  • Deliver Sessions via video only

Minimum listing price: $5 USD

4.3 Communication

All communication must occur within the Platform.
Sharing external contact details is prohibited.

4.4 Cancellations

  • Experts have 5 free cancellations per month
  • No-shows count as cancellations
  • Excessive cancellations may lead to account suspension

4.5 Payments

  • Payments are made in CANitude Credits
  • Funds are released after the Review Period
  • Withdrawals require payment processor integration

5. Learners

5.1 Learner Accounts

Learners can:

  • Search Experts
  • Purchase CANitude Credits
  • Attend live Sessions
  • Leave reviews

5.2 Cancellations

  • Free cancellation 24+ hours before Session
  • No refund for late cancellations or no-shows

5.3 Reviews

Reviews must be honest and lawful.
The Company may remove reviews that violate policy.

6. Listing Policy

Listings must:

  • Be accurate and lawful
  • Avoid offensive language
  • Exclude external links or contact info
  • Respect intellectual property laws

Prohibited Listings include:

  • Fraud-enabling services
  • Weapons or illegal substances
  • Services violating U.S. law

7. Dispute Resolution

Disputes must be raised within 72 hours after Session completion.

Refunds may be issued if evidence proves service mismatch.
Quality dissatisfaction alone does not guarantee refunds.

8. CANitude Credits

  • Credits are non-transferable
  • Credits are non-refundable (unless required by law)
  • Credits may be forfeited upon account termination

9. Account Registration & Security

Users must:

  • Provide accurate information
  • Verify email
  • Protect login credentials

You are responsible for all activity on your account.

10. Account Termination

Accounts may be terminated:

  • By user (delete account)
  • By Company (with or without cause)

All credits are forfeited upon termination.
